ZERO TO HERO PROGRAM - SERVICE AGREEMENT & TERMS

Effective Date: December 9, 2024.

Program Name: Zero to Hero Assisted Living Mentorship Program.

1. PROGRAM DESCRIPTION

The Zero to Hero Program is a 100% self-paced digital educational program providing training and resources for individuals interested in learning about the assisted living and group home industry.

What You Receive:

• Access to pre-recorded video training modules.
• Downloadable templates and resource documents.
• Access to private online community forum.
• Educational materials and reference guides.
• Lifetime access to program content (for the life of the program).

What This Program IS NOT:

• This is NOT a done-for-you service.
• This is NOT personal coaching or one-on-one mentorship.
• This is NOT legal, financial, or professional consulting.
• This is NOT licensing assistance or representation.
• This is NOT a guarantee of business success or income.

2. INVESTMENT & PAYMENT TERMS

Total Program Investment: $3,000.

Payment Options:

Option A: Pay in Full

• One-time payment of $3,000.
• Immediate full access to all materials.

Option B: 12-Month Installment Plan

• 12 monthly payments of $250 each.
• First payment due at enrollment.
• Subsequent payments automatically charged monthly.
• Full access to materials from day one.
• Continued access requires payments remain current.

Payment Terms:

• All payments are NON-REFUNDABLE after 30-day guarantee period.
• Installment plan is a binding 12-month payment commitment.
• You are responsible for all 12 payments regardless of program completion or usage.
• Missed payments will result in suspended access until account is current.
• Outstanding balances may be sent to collections (see Section 10).
• No refunds for partial completion or dissatisfaction after guarantee period.

3. 30-DAY MONEY-BACK GUARANTEE

We offer a 30-day satisfaction guarantee from the date of enrollment.

To Request a Refund Within 30 Days:

• You must submit a written refund request to [email protected].
• You must demonstrate completion of the first 2 modules.
• Refunds processed within 14 business days.
• For installment plans: refund applies only to payments made to date.

After 30 Days:

• ALL SALES ARE FINAL.
• NO REFUNDS for any reason, including:
• Changed mind or buyer's remorse.
• Lack of time to complete program.
• Technical difficulties on your end.
• Not achieving desired results.
• Not obtaining licensing or permits.
• Business failure or financial hardship.
• Dissatisfaction with content.

4. NO RESULTS GUARANTEED - EARNINGS DISCLAIMER

We make absolutely NO GUARANTEES regarding:

• Income, revenue, or profitability.
• Licensing or permit approval.
• Client acquisition or placement.
• Business success or outcomes.
• Return on investment.
• Speed of results or implementation.

Licensing depends on factors including:

• Your criminal background and history.
• Your financial situation and credit.
• Property compliance with codes and regulations.
• State agency decisions beyond our control.
• Local zoning and municipal approvals.

We have NO influence over government agencies and CANNOT intervene on your behalf.

8. NO CLIENT ACQUISITION GUARANTEES

We do NOT guarantee:

• You will acquire any clients or residents.
• Referral sources will work with your facility.
• Any specific occupancy rates or revenue.
• Relationships with case managers or agencies.
• Steady client flow or business stability.

Client acquisition depends on numerous factors beyond our control including local market conditions, competition, facility quality, reputation, and your relationship-building efforts.

9. INTELLECTUAL PROPERTY & USAGE RESTRICTIONS

All program materials are protected by copyright and intellectual property laws.

You May:

• Access and view materials for your personal use.
• Download templates for use in YOUR business only.
• Implement strategies taught in the program.

You May NOT:

• Share, copy, or distribute program materials.
• Record, screenshot, or reproduce video content.
• Use materials to create competing products or services.
• Teach or train others using our content.
• Sell or resell any program materials.
• Upload content to file-sharing sites or public platforms.

Violations Will Result In:

• Immediate termination of access without refund.
• Legal action for damages and injunctive relief.
• Pursuit of maximum penalties under copyright law.

10. COLLECTIONS & PAYMENT DEFAULT

For Installment Plan Enrollees:

If you fail to make payments as agreed:

• Your account will be considered in default after 15 days.
• Access to program materials will be suspended immediately.
• Outstanding balance remains due in full.
• Account may be sent to third-party collections agency.
• You will be responsible for:
• Collection agency fees (up to 35% of outstanding balance).
• Reasonable attorney's fees and court costs.
• Interest on unpaid balance at maximum legal rate.
• All costs associated with collections efforts.

Collection Contact Authorization: By enrolling, you authorize us and our designated collection agencies to contact you via:

• Telephone (including wireless numbers which may incur charges).
• Text messages (message and data rates may apply).
• Email using any address you provided.
• Mail to any address you provided.
• Pre-recorded/artificial voice messages.
• Automatic dialing devices.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability to you is limited to the amount you paid for the program.
• We are NOT liable for any indirect, incidental, consequential, or special damages.
• We are NOT liable for lost profits, business interruption, or business failure.
• We are NOT liable for decisions you make based on program content.
• We are NOT liable for actions or inactions of government agencies, referral sources, clients, or third parties.
• We are NOT liable for content accuracy, completeness, or applicability to your situation.

You agree to indemnify and hold us harmless from:

• Any claims arising from your use of program content.
• Your operation of any business based on program teachings.
• Your violation of any laws or regulations.
• Your infringement of third-party rights.
• Any injury, damage, or loss caused by your actions.

12. PROGRAM MODIFICATIONS & DISCONTINUATION

We reserve the right to:

• Update or modify program content at any time without notice.
• Change community platform or format.
• Discontinue the program with 90 days notice to active members.
• Modify these terms with notice to enrolled members.

"Lifetime Access" Definition:

• Means access for the life of the program, not your lifetime.
• The program may be discontinued at our sole discretion.
• Upon discontinuation, access ends and no refunds will be issued.
• We will provide 90 days notice before discontinuation.

13. NO PARTNERSHIP OR EMPLOYMENT

Enrollment in this program does NOT create:

• Partnership or joint venture relationship.
• Employer-employee relationship.
• Franchisor-franchisee relationship.
• Agent-principal relationship.
• Any fiduciary duty or special relationship.

You are an independent consumer purchasing educational content.

14. DISCLAIMERS & WARRANTIES

AS-IS BASIS: This program and all materials are provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, express or implied, including but not limited to:

• Warranties of merchantability.

• Non-infringement.

• Error-free or uninterrupted access.
• Freedom from viruses or harmful components.

We do NOT warrant that:

• Program content is accurate, current, or complete.

• You will achieve any particular results.

15. DISPUTE RESOLUTION

Governing Law: This agreement is governed by the laws of Arizona, without regard to conflict of law principles.

Arbitration Agreement: Any disputes arising from this agreement or your use of the program must be resolved through binding arbitration in Maricopa County, Arizona under the rules of the American Arbitration Association.

You Waive:

• Any right to jury trial.
• Any right to participate in class action lawsuits.
• Any right to bring claims in court (except small claims court).

Exceptions: We may seek injunctive relief in court for intellectual property violations or payment disputes.

16. SEVERABILITY

If any provision of this agreement is found invalid or unenforceable, all other provisions remain in full force and effect.

17. ENTIRE AGREEMENT

This service agreement, together with the Privacy Policy and any order forms, constitutes the entire agreement between you and PAMOJA PAMOJA LLC regarding the Zero to Hero Program. No verbal promises or representations modify this agreement.

18. ACCEPTANCE

BY ENROLLING IN THIS PROGRAM, YOU ACKNOWLEDGE THAT:
